Israel releases 12-year-old boy from prison

Hebron - Ma'an - Hassan Al-Muhtaseb, 12, was released Sunday, when an Israeli military court in Ofer prison ordered his father to pay 2,000 shekel fine.

The Palestinian Prisoners' Society appointed ten lawyers to assist in the child's defense. Many of his relatives were allowed to be present during the hearing.

"The boy was detained near his family home, and there were no witnesses who testified that he threw stones at Israeli soldiers. No indictment was filed against the boy. This hearing contradicts the 1989 convention on children’s rights which Israel signed in 1991 according to which a minor can’t be jailed with adults. Thus, we demand immediate release of Hassan," said one of the lawyers representing the child.

Heated discussions ensued during the first session of the hearing between the lawyers and the Israeli judge who insisted that the boy’s father, Fadl Al-Muhtaseb, pay a 2,000 shekel fine. However, the child's lawyers had the fine order revoked, with the judge ordering in its stead a commitment from the father that Hassan will appear before the court if summoned.

Hassan’s older brother, Rashid, extended his hand to his brother, but was restrained by Israeli police. The father also was prevented from holding his son, and a heated argument followed with Israeli forces.

The child told attendees that he was not afraid to stand trial before the military court.

On Wednesday, Hassan's detention was extended, with his father commenting, "My child was brought to court with both his hands and feet cuffed. He was very scared of the many soldiers around him. It is ironic that the judge extended his detention until Sunday until an indictment is issued against him," he said.

Al-Mutaseb was asked to pay a fine of 5,000 shekels, which was then reduced to 2,000 shekels. "What law allows a child to be tried in court and then asks his father to pay a fine? I will not pay the fine, and you have to release my child."

"This is the law of Israel's occupation," the father said.

The lawyer representing Hassan, Lea Tsemel, handed the child a small balloon from her briefcase for him to play with, which brought laughter to the court room. The presiding judge reportedly attempted to conceal his face when the toy was given to the boy.

Hassan was detained on Monday with his brother Al-Amir, 9, who was later released.

According to article 37 the UN Convention on the Rights of the child, which Israel ratified on 3 October 1991, "The arrest, detention or imprisonment of a child shall be in conformity with the law and shall be used only as a measure of last resort and for the shortest appropriate period of time."

In the USA, any 12 year old accused of a crime, would be charged as a Juvenille Delinquent and retained by the authorities until such time as judgement was made as to the severity of the allgeged crime, or else handed over to his parents with the admonishment that the keep their eyes on him so he doesn't get involved in anymore potential troubles

Ben Jabo is a joke. First he was imprisoned with adults against the treaty. There were no witnesses against him. The US and Israel breaking all the laws against treatment of children.

If you were reading correctly, "no witnesses who testified that he threw stones at Israeli soldiers." It is for sure you are one of those people who live by the rule, "see nop evil, hear no evil", so knowing that the boy is innocent and this is one of your government tatics of terrorism of course you are going to turn blind sighted. In the United States, children that do commit a crime are innocent until proven guilty and recieve a fair trail.

Also, Ben Jabo in the United States children are not imprison in a detention center with adults, they are given a fair trail, and are not seperated from their families. You can not compare Isreali courts treatment with Palestinian children, women, and men to the United States courts. There is a major difference. Also, I might add with any courts around the world! Isreali courts do not practice fair justice, equal rights, and justice for all, that is why the Intefada is still alive.

If the is Isreali courts and government practice fair trail and justice for all, then 98% of the Isreali people would be in jail now for murder, rape, torture, theif, the use of unlawful weapons, child endangerment, harassment, child abuse, discrimination, teaching their children to kill, attacking religious centers, and the list goes on and on and on. So please do not talk about justice or laws when your own people do not practice it and that goes for everyone and who believes the same as you.

You really can't compare what evils a handful of Palestinians commit to what a so-called civilized and democratic nation like Israel commits. Those Palestinians are fighting for freedom, the pariah state of Israel is fighting for unethical racial cleansing. They are doing everything they can to discourage Arabs from coming to Palestine and also to put the people living in Palestine in complete misery so that they may leave and Israel can slowly gain control over the whole land.

As someone who works in Juvenile courts in the U.S, I would have to say that a lot of illegal things happen to youth and many do not get fair trials and families have no coping means. If u are black or brown or poor white u are screwed and the courts and justice system does not work for u. That said, Israel is a cruel pathetic state on the way out--by their own decaying doing.

What makes a person wake up one day and decide that this is their only means of juctice? To answer those questions, why7 don't you look at the history behind the occupation. Do you know your own history? Canada and America was one country that belong to the Northern and Southern Indians. When your people came to this country, your people massacre the Indians that lived in those parts. As for the international community, it is not them that do not respect us, it is us that do not respect them. Because they by false rules, they are the HYPOCRITES of the meaning of justice, freedom, and equality. If they know and understand their code of ethics then they would not turn blind sided for all the international and humanity crimes that Isreali prime monsters and their army have done. People are not born to kill they are made to kill. So to answer the question, the Isreali occupation and their supporters created suicide bombers. 2500 and maybe more have died in the Gaza massacre, all where innocent victims. What did this child do? Nothing but being who he is a Palestinian.

Mr. Haymond, yes the Palestinians commit terrorism. I have kept scrupulous records of who does what to whom on a daily basis, for years. In 2009 Israel committed about 50 to 100 times the terrorism that Palestine committed against Israel. By that I mean harm to unarmed civilians. I'm talking about killing defenseless civilians or wounding them, or destroying their property. 50-100 times as much done by Israel. Mr. Haymond, you would shut your mouth fast if you lived with Palestinians for a year.
