PCHR: Sharawna deportation violates Geneva Conventions

BETHLEHEM (Ma'an) -- The deportation to Gaza of hunger-striking prisoner Ayman Sharawna is a violation of the Geneva Conventions, a Palestinian rights group said Monday.

Sharawna arrived in the Gaza Strip on Sunday evening after signing a deportation deal to end an 8-month long hunger strike in Israeli jail.

Forcible deportation is a form of collective punishment prohibited under the fourth Geneva Convention which prohibits "individual or mass forcible transfers, as well as deportations of protected persons from occupied territory to the territory of the Occupying Power or to that of any other country, occupied or not," PCHR said in a statement.

The deal stipulates that Sharawna would stay in Gaza for 10 years before being able to return to his home in Gaza.

A 2011 prisoner swap deal between Israel and Hamas saw 40 Palestinians deported to other countries and 163 to the Gaza Strip, PHCR said, calling for all deportees to be allowed to return home.

Sharawna, 36, is from the southern West Bank city of Hebron, and is married with nine children.

He was released in the Oct. 2011 prisoner swap deal between Israel and Hamas but was rearrested in Jan. 2012 and accused of violating the terms of his release.

Israeli authorities refused to reveal how Sharawna violated his release terms, even to his lawyers, and he was jailed without charge or trial.

Israeli prosecutors sought to cancel Sharawna's amnesty and jail him for 28 years, the remainder of his previous sentence. He went on hunger strike to demand his release.

If he does not like deportation he should stay in jail and serve the remaining 29 years. In full compliance with Gen?ve Convention.

No use for Human Rights watch to remind Palestinians of Geneva Convention. Palestinians are well aware, but continue to hope for US to intervene. US will never favour Palestinians where Israsel is concerned. Even the recent poll suggested that majority of US citizens don;t favour Palestinians. confirms how ignorant US citizens are. Their view is " I am alright jack, rest can go to hell except for Israel". How can one trust Amercians!!!

#1 - when did Israel abide by the Geneva convention? Have you looked at the terror inflicted on civilians since before the creation of the state o ISrael, up to now? Be a bit more even-handed.

PHCR is correct re: the Articles of the Gen.Cons,where USA is co-signatory,yet ROUTINELY flouts the Conventions by weakly permitting militarist-junta-Israel to commit repeated WAR CRIMES against Palestinian civilians(&others)for 1/2 a CENTURY .Israel's a ROGUE-TERROR-STATE,outside of any Rule of(Universal)Law or Due Process.Just as our USG has become,by misguided association&ego.Are PRO-American attitudes GROWING,globally?NO!With good reason!Good doesn't come from cruel MIGHT,but what's right!

The Palestine Israel Conflic will not end by blaming each other lets find common ground and build on it Palestinian should start struggling for equal rights rather fighting for an independant state as such state will not be viable regardless how optimistic we might be Palestinians can't afford to build a state besides a having a separate state will divide Palestinians themselves for the sake of our children lets live to gather in peace and harmony .
